2. Data Collection – Local Solutions
For Local 1 PC and Local 5 PC solutions:
- ToolingMind does not collect, transmit, or store customer operational data.
- All data remains under the exclusive control of the client.
- ToolingMind has no remote access to client production data.
- The client acts as Data Controller under GDPR and equivalent laws.
3. Data Collection – SaaS Solution
For the SaaS solution:
- Data processing conditions are defined in a separate contractual agreement.
- ToolingMind acts as Data Processor under GDPR, where applicable.
- Security, hosting, access rights, and retention periods are contractually defined.
4. Purpose of Data Processing
Where applicable, data is processed solely to:
- Provide the ToolingMind service,
- Generate analytics and AI-based recommendations,
- Improve platform functionality without exposing identifiable client data.
5. Data Accuracy and Responsibility
Clients are responsible for ensuring that all data entered into ToolingMind is:
- Accurate,
- Lawfully collected,
- Relevant for the intended analysis.
ToolingMind is not responsible for inaccuracies resulting from incorrect input data.
6. Data Security
- Local solutions: security is fully managed by the client’s IT infrastructure.
- SaaS solutions: security measures (encryption, access control, backups) are defined contractually.
7. Data Retention
- Local solutions: retention is fully controlled by the client.
- SaaS solutions: retention periods are defined in the service agreement.
8. Third-Party Services
ToolingMind may rely on third-party technology providers (including AI services). Client-identifiable data is not shared beyond what is strictly necessary and only under contractual safeguards.
9. User Rights (GDPR & Canadian Law)
Depending on jurisdiction, users may have the right to:
- Access their data,
- Request correction,
- Request deletion or restriction (where applicable).
For SaaS solutions, such requests are handled according to the contractual agreement.

This Privacy Policy may be updated periodically. The latest version of privacy policy will always be published on the official ToolingMind website.
